Welcome to Public Display Agency Inc. By accessing or using our website and services, you agree to comply with and be bound by the following Terms of Service. If you do not agree to these terms, please do not use our website or services.

1. Services Provided
Our website provides the following services:

Event registration and ticket sales.

Access to content related to our events and participating artists.

Artist pages featuring user-generated content (e.g., images, URLs).

2. User-Generated Content
Artists who upload content to their profiles retain ownership of their work. By uploading content, you grant us a non-exclusive, royalty-free license to use, display, and promote your work in connection with the events you are registered for.

3. Refund Policy
Our refund policy is as follows

At Public Display Agency Inc., we strive to create accessible opportunities for artists while ensuring the sustainability of our events. Due to the nature of event planning and financial commitments required to host these showcases, we have established the following Refund Policy:

General Refund Policy
All ticket-based entries and booth fees are non-refundable. Once a payment is made, it is final.
Artists who register for Flexible Entry tiers (Tickets, Shared Display, or Work Exchange) acknowledge that their participation is secured through financial or labor-based commitment and cannot be reversed.
No refunds will be provided for missed events or failure to meet ticket sales requirements.

Event Cancellation & Postponement
If Public Display Agency Inc. cancels an event, all artists and ticket holders will be given the option of:
A full refund of any fees paid.
A credit toward a future event.
If an event is rescheduled, all tickets and artist fees will be transferred to the new date. No refunds will be provided unless an artist or ticket holder can demonstrate that they are unable to attend the rescheduled event.

Ticket Sales & Transfers
Artists participating in the Flexible Entry – Ticket Sales tier are responsible for selling their allocated tickets.
Tickets are non-refundable but may be transferred to another guest.
In the case of ticket disputes, the ticket holder should contact the artist they purchased from or our support team.

Special Circumstances
Refunds may be considered in exceptional cases, such as medical emergencies, at the sole discretion of Public Display Agency Inc.
Requests for refund consideration must be submitted in writing at least 10 days before the event and include supporting documentation.

Chargebacks & Disputes
Chargebacks and payment disputes will be handled in accordance with payment processor policies (Square/Stripe).
Any chargebacks deemed invalid will be contested, and legal action may be taken against fraudulent claims.

4. Disclaimers
Artistic Content: We do not own the rights to any artist work displayed on our website. Artists retain full ownership of their content.

Event Liability: Public Display Agency Inc. carries liability event insurance with coverage up to $1 million. However, we are not responsible for any loss, damage, or injury incurred during events beyond the scope of our insurance coverage.

Website Availability: We do not guarantee uninterrupted access to our website or services.

5. Event Photography
At our events, a staff photographer may capture images of the overall event, including performances, attendees, and venue spaces. Public Display Agency Inc. owns the rights to these photographs and may use them for marketing, promotional, and archival purposes beyond the event.

If you have concerns about your image being used, please contact us at help@publicdisplayagency.ca prior to the event. While we cannot guarantee that your image will not be captured, we will make reasonable efforts to address your concerns.

6. Code of Conduct
Public Display Agency Inc. is committed to fostering an inclusive, respectful, and safe environment for all attendees, artists, and staff. We welcome everyone, regardless of race, ethnicity, gender identity, sexual orientation, disability, religion, or any other characteristic.

To ensure our events remain a safe space, we have established the following Code of Conduct:

Respect and Inclusion
All participants are expected to treat others with respect and dignity.

Harassment, discrimination, or any behavior that makes others feel unwelcome will not be tolerated.

Zero Tolerance for Harassment
Harassment includes, but is not limited to, offensive comments, verbal abuse, intimidation, unwelcome physical contact, and inappropriate use of event spaces.

Venue-Specific Conditions
Each venue may have its own rules and restrictions. By attending our events, you agree to comply with the following venue-specific conditions:

Prohibited Items:
Weapons, illegal substances, and outside food or beverages (unless explicitly permitted by the venue) are not allowed.

Age Restrictions:
Some venues may have age restrictions for entry. Please check event details before purchasing tickets.

Smoking and Alcohol:
Smoking and alcohol consumption are permitted only in designated areas, as per venue policies.

Noise Levels:
Please respect noise restrictions, especially in venues located in residential areas.

Accessibility:
If you require accommodations due to a disability, please contact us in advance so we can work with the venue to ensure accessibility.

Reporting Issues
If you experience or witness behavior that violates this Code of Conduct, please report it immediately to event staff or contact us at [insert email address or phone number].

All reports will be taken seriously and addressed promptly.

Consequences
Anyone violating this Code of Conduct or venue-specific conditions may be asked to leave the event without a refund and may be prohibited from attending future events.

By attending our events, you agree to abide by this Code of Conduct and contribute to creating a welcoming and inclusive environment for all.

7. Limitation of Liability
To the fullest extent permitted by law, Public Display Agency Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or services.

8. Governing Law
These Terms of Service are governed by the laws of British Columbia and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of British Columbia.

9. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with an updated effective date.
